Post injury drug testing

We have long been proponents of post injury drug testing. Regulation changes at the end of the Obama administration have raised questions. While the tests are still allowed, the regulations are intended to keep from discouraging workers from reporting injuries.

While waiting for the regs to be flushed out here are our suggestions:

  • Make sure there is a possibility that drugs or alcohol contributed to the incident
  • Test as quickly as possible after the incident, preferably when first medical treatment is received
  • Be consistent, meaning test everyone in the vicinity of the incident
  • Best Advice: have a good policy in place and enforce universally
